The American Civil Liberties Union of South Dakota has filed a federal lawsuit against the state of South Dakota for its newly-passed SB 189. The bill made into law this session, known as “Riot Boosting” makes it easier for authorities to arrest and charge individuals seeking to take part in protests, or people who fund said protestors. The bill was passed in preparation for a possible protest of the Keystone XL pipeline construction through portions of South Dakota. According to the ACLU this bill infringes on first and 14th amendment rights. Gov. Noem said when signing the bill it is to ensure safety and efficiency of pipeline construction.
