The Brown County Commission through its representation has asked a federal judge to dismiss a lawsuit filed by Summit Carbon Solutions. Summit Carbon Solutions is trying to build a carbon capture pipeline through parts of central and northeast South Dakota. Brown County is one of three county commissions including McPherson and Spink to file a moratorium on pipeline construction which is set to expire on July 19th. The county’s representation argued Summit had the ability to do surveying without permission from landowners, per a decision from a different judge, but construction could not begin until they got permission from the state.
