As the Buffalo Chip Campground swells for the Sturgis Motorcycle Rally, Judge Gordon Swanson this week ruled against a request to dismiss the state of South Dakota’s lawsuit challenging it as a city.
Lawyers for the Buffalo Chip argued before Judge Swanson July 31 that the state didn’t have the authority to dissolve an existing municipality.
The State argues it does, indeed, have that authority, and accuses the Buffalo Chip was not properly established.
Judge Swanson’s refusal of the dismissal of the case sets up yet another court battle.
The city of Sturgis and several Meade County landowners initially brought forth the lawsuit several years ago, saying Meade County Commissioners erred in allowing the vote to incorporate.
After the state Supreme Court sent the issue back to the state court, the case was picked back up with the State of South Dakota as the head plaintiff.
