Pierre man changes plea in assault on law enforcement charges

(DRG News – Pierre, SD) A Pierre man charged with two counts of Aggravated Assault of a Law Enforcement Officer and one count of Simple Assault Domestic Violence entered pleas Monday (Dec. 18, 2023) at the Hughes County Courthouse.

Henry Jacobsen plead “no contest” to the Aggravated Assault charges which specifically refer to actions taken against Pierre Police Officer Zachery Bruzelius and Highway Patrol Trooper Mike Dale.

On the Simple Assault charge, Jacobsen took exception to the use of the word “intentionally” in reference to the argument he was having with his girlfriend, identified as “SK,” who received minor injuries after he pushed her and she fell and hit her head. After a brief recess, Assistant Attorney General Jessica LaMie (la-me) filed new paperwork changing the verbiage on the charge to “recklessly.” Jacobsen then plead “guilty.”

The charges stem from a March 7, 2023, incident where Jacobsen barricaded himself in his home in the Spring Creek area approximately 15 miles north of Pierre. The situation was first reported at 5:30 that morning. He surrendered to law enforcement six hours later (11:32am). There were no injuries.

The Aggravated Assault charges each carry a possible maximum penalty of 25 years in the state penitentiary, a $50,000 fine or both. The Simple Assault charge carries a maximum penalty of one year in the county jail, a $2000 fine or both.

A pre-sentence investigation was ordered. Sentencing was set for Feb. 2, 2024, at 1pm. Jacobson remains in the Hughes County Jail on a $40,000 cash bond.

Agencies responding included the U.S. Marshals Service, FBI, South Dakota Highway Patrol, Pierre Police Department, Hughes County Sheriff’s Office, Sully County Sheriff’s Office and American Medical Response ambulance service.
