A Minnehaha county judge Tuesday denied a request by Dakotan’s for Health to dismiss the lawsuit it currently faces regarding its proposed constitutional amendment regarding abortion. Anti-abortion group Life Defense Fund has filed a lawsuit against the group claiming it broke South Dakota law while acquiring the necessary signatures to get the amendment on this November’s ballot. Dakotan’s for Health denies any wrong doing during the signature collecting process and claims the Life Defense Fund and other anti-abortion activists are simply worried this amendment will pass. The judge in this case set a trial date on the matter for the end of September.
