Federal judge rules School of Mines student from India may remain in the US despite DOH’s attempt to deport

A federal judge has ruled a South Dakota School of Mines student from India may remain in the country. According to the ruling by District Judge Karen Schreier, the Department of Homeland Security cannot terminate Priya Saxena’s student visa and have her removed from the country. Saxena is currently enrolled in a Ph.D. Program at Mines, but was notified in April her visa was being revoked. The judge called canceling her visa quote “arbitrary and capricious”.
