South Dakota’s new “Move Over” law goes into effect Tuesday July 1st

(DRG News – Pierre, SD) South Dakota’s updated ‘Move Over’ law goes into effect Tuesday (July 1, 2025).

Highway Patrol Trooper Troy Archambeault (ARE-shm-BO) says the updated law requires motorists to move over for ANY VEHICLE on the side of the road with flashing amber, yellow or blue warning or hazard lights.

A violation of South Dakota’s Move Over law is a Class 2 misdemeanor. However, Archambeault says there’s a stronger consequence if you don’t move over and you cause a crash.

Archambeault says one section of the Move Over law that doesn’t change from the current law to the updated law is that you are required to slow down on some roadways.

Not only does South Dakota’s updated Move Over law apply to vehicles stopped along the side of the road, but it also applies to slow moving vehicles that have properly operating hazard lights turned on– such as tractors and Department of Transportation equipment.
