South Dakota’s medical marijuana program is now legal under federal law according to South Dakota Attorney General Marty Jackley. Jackley issued the opinion at the request of the state legislature’s medical marijuana oversight committee. The committee sought clarity on the matter following the Trump administration’s executive order on April 22nd of this year, partially changing the scheduling classification of marijuana on the federal level. The order declared marijuana as a schedule III drug for state-licensed programs. Otherwise marijuana remains a schedule I drug, up there with heroin and LSD on the federal level.
