An Aberdeen man has been sentenced regarding his part in an accident in December of 2024 that lead to the death of a cyclist. According to the Aberdeen Insider, 29-year-old Brandon E. Smith was sentenced to 60 days in jail all suspended, and fined approximately $1,200 on ingesting an intoxicant other than alcohol, not having insurance and careless driving charges. He pleaded guilty to all the charges, except careless driving which he pleaded no contest. 65-year-old Roger Genung died as a result of the accident. He was biking on the shoulder of second avenue northeast near the intersection with North Lincoln Street around 9:45 p.m. Prosecutors say there was not enough evidence to prove he was impaired and he did not flea the scene resulting in a class 2 careless driving charge.
