South Dakota Governor Larry Rhoden has issued his second veto of the 2026 legislative session. Governor Rhoden on Wednesday vetoed House Bill 1138, which would have required non medical home care agencies to get a license and provide proof of training. In a statement on the decision, Governor Rhoden says he supports the cause of the legislation, but worries about too much government regulation without delivering meaningful consumer protections. The governor goes on to claim, in his understanding of this bill, anyone who is paid to cook meals or clean a house for an adult would be classified as a non-medical home care agency, which would require a state license.
