Following the US Court of Appeals Eighth Circuit’s decision to deny a South Dakota death row inmate’s attempt to overturn his death sentence, Attorney General Marty Jackley says the execution could take place this year. 46-year-old Briley Piper was one of three men involved in the death of then 19-year-old Allan Poage in April of 2000. Jackley said in a statement following the court’s decision, an appeal to the US Supreme Court is more than likely and unless the highest court in the nation chooses to overturn his death sentence Piper will likely be executed probably in November or December of this year. The last person executed by the state of South Dakota was Charles Russell Rhines in November of 2019.
