According to the Aberdeen Insider, Summit Carbon Solutions has been granted permission by a judge to conduct survey work without being granted permission by landowners. The decision was laid out by judge Richard Sommers in a ruling in a civil lawsuit between the company and landowners in Brown, Spink, McPherson and Edmunds counties. Landowners argued a state law allowing survey work on private land without permission violates the state and US constitution. That state law in question allows entities who have applied for a permit with the State Public Utilities Commission are allowed to survey land without consent as long as they give a 30-day notice to the landowner.
