40-year-old Joseph Hoek of Sioux Falls appeared in a Moody county courtroom Wednesday for another preliminary hearing. Hook is facing first degree murder charges along with evading arrest in the death of 51-year-old Ken Prorok, a Moody County sheriff’s deputy. Also during the hearing it was revealed, the defense has field a motion to receive a mental health evaluation, which will determine if Hook is competent to stand trial and the defense said they reserve the right to use an insanity plea.
