State to seek death penalty in Joseph Hoek case

40-year-old Joseph Hoek of Sioux Falls appeared in a Moody county courtroom Wednesday for another preliminary hearing. Hook is facing first degree murder charges along with evading arrest in the death of 51-year-old Ken Prorok, a Moody County sheriff’s deputy. South Dakota Attorney General Marty Jackley was there and announced the state would seek the death penalty in this case. Jackley explained further…

Also during the hearing it was revealed, the defense has field a motion to receive a mental health evaluation, which will determine if Hook is competent to stand trial and the defense said they reserve the right to use an insanity plea.
